What causes bottlenecks that require interim legal counsel?
The bottlenecks that make interim legal counsel necessary are mainly caused by vacancies, absences such as parental leave, peak workloads, projects requiring specialist knowledge and new regulatory requirements. In all of these cases the additional demand is temporary – which is why interim support is often more sensible than an additional permanent hire.
This guide is for general counsel, heads of legal, heads of compliance and HR leaders in Germany, Switzerland and Austria. It describes the six most common causes, the warning signs, and when interim support helps – and when it does not.
Six causes of bottlenecks in legal departments
- Vacancy: a lawyer leaves the company and a successor has not yet been found. The portfolio still needs to be handled, often for several months.
- Planned or unplanned absence: parental leave, maternity leave, a sabbatical or long-term illness. In small legal teams, this removes a large share of capacity.
- Peak workloads: seasonal contract waves, reorganisations, site projects or a growing contract review backlog tie up the team for weeks.
- Projects requiring expertise: transactions (corporate/M&A), contract migrations, data protection projects or investigations need experience the team does not always have.
- Regulatory change: new requirements such as DORA, NIS2, the EU AI Act or stricter AML/KYC rules create implementation work with fixed dates – on top of day-to-day business.
- Growth and change: new markets, products or entities increase demand for legal advice faster than new positions can be approved and filled.
How to spot a bottleneck early
- Response times to the business increase and contract approvals are delayed.
- More routine work goes to external law firms and costs rise.
- Strategic topics such as policies, training or process improvements are postponed.
- Overtime becomes the norm and the risk of errors and staff turnover grows.
- Regulatory projects start later than planned.
Which support fits which cause?
| Cause | Typical duration | Suitable support |
|---|---|---|
| Vacancy | until the role is filled | interim legal counsel taking over the portfolio |
| Parental leave or illness | several months, plannable with handover | cover with an overlap period |
| Peak workload or backlog | a few weeks to months | additional professional or small team, also part-time |
| Project requiring expertise | project duration | interim specialist or project team |
| Regulatory implementation | until the implementation deadline | compliance or legal specialists, as a task force if needed |
| Permanent growth | open-ended | permanent hire, bridged by interim support if needed |
When interim support helps
Interim legal counsel makes sense when additional demand is temporary, hard to plan or tied to a project. Alpinum Solutions provides temporary legal and compliance professionals through staff leasing or freelancing, part-time or full-time, from a single interim specialist to a project team, at all levels from junior to mid-level to senior.
- With staff leasing (Arbeitnehmerüberlassung in Germany, Personalverleih in Switzerland), the professional is integrated into your organisation; you generally hold the right to give professional instructions.
- With freelancing, the professional delivers the work independently within an agreed mandate.
In both models your company manages the assignment. Alpinum is not a law firm and does not provide independent legal advice.
When another solution is better
- Permanent additional demand: if the work will remain long term, a permanent hire is usually the better choice – interim support can bridge the time until the role is filled.
- A single specialist question: for an opinion or litigation, a specialised law firm remains the right partner.
- Unclear tasks: without a brief and a contact person, even an experienced professional can achieve little. First clarify which work is piling up.
Examples from practice
- Parental leave: an international industrial company in the DACH region covered a parental leave with a senior legal counsel through staff leasing – nine months including a one-month overlap. The legal department stayed fully operational and external legal fees fell significantly.
- Regulatory backlog: in 2025, a financial institution deployed a task force of eight compliance officers including a team lead for a KYC remediation (staff leasing, full-time). The project, covering KYC file reviews, transaction monitoring and alert handling, was completed within ten months.
By its own count, Alpinum Solutions supports more than 120 assignments per year, lasting from a few weeks to several months or longer (as of 18 October 2026). Selected profiles are usually available within 48 hours; the start date is agreed jointly by the client and Alpinum.
